Welcome to Zestro! These Terms of Service ("Terms") govern your use of our website and services operated by Zestro. By accessing or using our website, you agree to be bound by these Terms.

1. Acceptance of Terms and Eligibility

By creating an account, making a purchase, or using our website, you acknowledge that you have read, understood, and agree to these Terms of Service. You must be at least 15 years of age to use our services. If you do not agree to all terms and conditions, please discontinue use of our services immediately.

2. Account Registration and Security

You must create an account to place orders on our website. You are entirely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide current, complete, and accurate information during registration and promptly update any changes to your account information.

3. Product Information, Pricing, and Accuracy

We make every effort to display product colors, descriptions, and specifications as accurately as possible. However, we cannot guarantee that your computer monitor's display will accurately reflect actual product colors. Small deviations, especially in color tones, cannot be deemed a defect. All prices are in Indian Rupees (INR) and are subject to change without notice. We reserve the right to correct any pricing errors, inaccuracies, or omissions at any time.

4. Orders, Payment, and Billing

Orders are subject to acceptance and product availability. We reserve the right to refuse, limit, or cancel orders at our sole discretion. Payment is required at the time of purchase (except for COD orders). We accept various payment methods, including COD, partial payment COD, credit cards, and digital wallets, as listed on our website. You agree to provide accurate billing information and are responsible for all charges incurred under your account.

5. Partial Payment COD Orders: 

For orders placed with partial payment (advance payment + cash on delivery):

• By making an advance payment, you enter into a binding purchase agreement with Zestro
• The advance payment is processed immediately and secures your order
• You are obligated to pay the remaining balance in cash to the delivery partner upon delivery
• Cancellation Policy: You may cancel within 24 hours of order placement for a refund of the advance payment minus processing fees. After 24 hours, cancellations will result in the forfeiture of the advance payment
• Order Refusal: If you refuse delivery, fail to pay the remaining balance, or are unavailable after 3 delivery attempts, the order will be cancelled, and the advance payment will be forfeited to cover processing and logistics costs
• Your Responsibilities: You must ensure availability to receive the order and have the exact cash amount ready for the remaining balance
• Failure to fulfill payment obligations may result in restrictions on future orders.

6. Shipping, Delivery, and Risk of Loss

Orders are typically dispatched within 5-6 working days from order confirmation. Delivery times vary by location and shipping method selected. We ship to one address per order only. Risk of loss and title for products transfers to you upon delivery. We are not responsible for delays caused by shipping carriers or circumstances beyond our control.

7. Returns, Refunds, and Exchanges

We accept returns only if there is a recorded video for damaged, defective, or incorrect items received. Returns must be initiated within 24 hours of delivery by contacting our customer support. Items must be returned in original condition with all original packaging. Refunds will be processed using the original payment method within 7-10 business days after we receive and inspect the returned item. We reserve the right to refuse returns that do not meet our return policy criteria.

For partial payment COD orders: If you receive a damaged or incorrect item, both the advance payment and any COD balance paid will be refunded in full after QC approval. Refunds for advance payments will be processed to the original payment method within 5 business days after approval.

8. Customer Obligations for Partial Payment Orders

When you place an order with partial payment:

• You acknowledge that the advance payment creates a binding commitment to complete the purchase
• You agree to be available at the delivery address to receive the order and pay the remaining balance
• You agree to have the exact cash amount ready for the COD balance to avoid delivery delays
• You understand that non-payment, refusal, or unavailability will result in forfeiture of the advance payment
• You agree that Zestro may restrict or refuse future partial payment orders if you have a history of order refusal or non-payment
• You acknowledge that all terms in our Shipping & Delivery Policy and Return & Refund Policy apply to your order.

9. Product Care, Quality, and Warranties

Our jewelry is anti-tarnish when properly cared for according to the provided care instructions. We do not warrant against normal wear, misuse, or damage caused by water exposure, chemicals, or improper storage. We provide products "as is" without any express or implied warranties except as required by law. Any manufacturing defects will be addressed in accordance with our return policy.

10. Intellectual Property Rights and Proprietary Content

All content on our website, including but not limited to designs, text, graphics, logos, images, and product designs, is owned by Zestro and protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission. Our jewelry designs are proprietary and protected by applicable intellectual property laws.

11. Prohibited Uses and User Conduct

You are prohibited from using our website or services for: (a) any unlawful purpose; (b) attempting to gain unauthorized access to our systems; (c) interfering with website functionality; (d) submitting false or misleading information; (e) posting fraudulent reviews; (f) violating any applicable laws or regulations; (g) transmitting viruses or malicious code; (h) collecting personal information of other users.

12. Disclaimer of Warranties and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZESTRO PROVIDES ALL SERVICES "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. Our total liability is limited to the purchase price of the specific product in question. We are not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid for the specific product giving rise to the claim.

13. Governing Law, Jurisdiction and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra. We both agree to first attempt to resolve disputes through good faith negotiations before pursuing legal action.
